Terms of Sales
These General Terms and Conditions of Sale (hereinafter referred to as the "GTC") are entered into on the one hand by the company MARMAX (hereinafter "Marmax") with a share capital of €9,803.00 whose registered office is located in Toulouse, registered with the Trade and Companies Register of Toulouse under number 833 453 442 the website www.stellaetsuzie.com (hereinafter the Site) and, on the other hand, by any natural or legal person wishing to make a purchase via the Site (hereinafter "the Customer").
Article 1. Purpose
These General Terms and Conditions aim to define the contractual relationship between Marmax and the Customer and the conditions applicable to any purchase made through the Site.
These General Terms and Conditions apply to the exclusion of all other conditions, including those applicable to sales in stores or through other distribution and marketing channels.
Any use of the Site implies the Client's unreserved acceptance of these Terms and Conditions, which the Client acknowledges having read prior to placing their order. In this respect, they are binding upon the Client in accordance with Article 1119 of the French Civil Code.
The Site allows the company Marmax to offer its products (hereinafter "the Products") in France and abroad.
Before any transaction, the Customer declares, firstly, that the purchase of Products on the Site is unrelated to their professional activity and is limited to strictly personal use, and secondly, that they have full legal capacity to enter into these Terms and Conditions. These Terms and Conditions govern the use of the Site and the services offered therein, as well as any purchase made on the Site.
Marmax reserves the right to modify these Terms and Conditions at any time, in order to comply with any new regulations or to improve the use of its website. Therefore, they will be applicable as soon as they are published online.
Article 2. Products
The Products offered are those listed on the Site, subject to availability.
Marmax reserves the right to modify its product collection at any time. Each product is presented on the website with a description outlining its main technical characteristics as accurately as possible. However, if any errors or omissions occur in this description, Marmax cannot be held liable.
The Customer is fully aware that the images, photos, and colors of the Products offered for sale may not correspond to the actual colors due to differences in internet browsers. Photographs are as accurate as possible but are not contractually binding on Marmax.
The sale of Products presented on the Site is intended for all customers residing in countries that fully authorize the entry of these products into their territory.
If one or more items ordered are no longer available, the Customer will be informed by email as soon as possible of the partial or total cancellation of their order.
Article 3. Pre-contractual information
The Customer acknowledges having received, prior to placing the order and concluding the contract, in a legible and understandable manner, these General Terms and Conditions and all information listed in Article L. 221-5 of the Consumer Code.
Article 4. Price
Prices are listed on the Product pages of the online catalogue and are prices in euros (€) for Europe, in pounds sterling for the United Kingdom and in dollars for the rest of the world taking into account the value added tax (VAT) applicable on the day of the order.
All prices shown are calculated and include value added tax (VAT) applicable in France or that applicable in the country of delivery located in the European Union.
Any change in the VAT rate may be reflected in the price of the Products.
Any local taxes that may apply to the sale are the responsibility of the Customer.
The prices shown do not include delivery charges, which are billed in addition to the price of the products purchased, according to the total amount of the order.
Marmax reserves the right to modify its prices at any time, it being understood however that the price appearing in the catalogue on the day of the order will be the only one applicable to the Customer.
In metropolitan France, for any order of 200 euros or more including VAT, shipping is free; for any order less than 200 euros including VAT, a flat fee for shipping costs will be charged to the Customer depending on the carrier chosen by the Customer.
For all deliveries within the European Union and Switzerland, shipping is free for orders over €250 (including VAT). For orders under €250, a flat shipping fee of €10 (including VAT) will be charged.
For all deliveries to the United States, Canada, and the United Arab Emirates, shipping is free for all orders.
For all international deliveries, shipping is free for orders over 300 euros including VAT, for orders under this amount a flat participation fee of 20 euros excluding VAT will be charged.
Outside the European Union, customs duties or import taxes may be added to the price of our products. These additional charges are entirely the responsibility of the customer. It is therefore the customer's responsibility to inquire about these costs with their local customs office.

Article 5. Ordering and payment terms
Before placing any order, the Customer must create an account on the Site. The account creation section is accessible directly from the sidebar menu bar.
When creating their account, the Customer must complete the form provided for this purpose and must provide their email address and a password and, as a secondary option, a date of birth in DD/MM format.
The Client is solely responsible for maintaining the confidentiality of their password and will bear sole responsibility for any fraudulent use of their password.
Before finalizing their order, the Customer must provide their name, surname, postal address and telephone number, this information being mandatory for the processing and delivery of orders and the issuing of invoices.
In accordance with the law of 6 January 1978, the Customer has a right to access, modify, rectify and delete data concerning him/her, which he/she can exercise in writing to Customer Service at the address contact@stellaetsuzie.com.
If the Customer is already registered, they will fill in their username and password to log in.
Marmax offers the Customer the option to order and pay for their products in several steps:
1. The Customer selects the products he/she wishes to order in the "shopping cart", and modifies them if necessary (quantities, references, etc.);
2. The Customer verifies the delivery address or enters a new one;
3. Shipping costs are calculated and submitted to the Customer, along with the name of the carrier;
4. The Customer checks all the information, reads and accepts these Terms and Conditions by ticking the corresponding box, then invites him to validate his order by clicking on the "Validate my order" button;
5. To securely enter their personal bank card details, the Customer is redirected to the secure payment interface of either PayPal, Shopify Payment, Apple Pay, or Alma. Payment information (bank card number, expiry date, authorization number, security code) is collected directly by our service providers. Marmax never has access to its customers' payment data.
Once an order has been validated, the Customer will no longer be able to modify its delivery address.
If the payment is accepted, the order is registered and the contract is definitively formed. Payment by credit card is irrevocable.
Payment is made in a single transaction by credit card (Visa, Mastercard, American Express, Bancontact or Paypal). Bank transactions are processed and secured by our partner SHOPIFY PAYMENT.
For any order of €200 or more (including VAT), the Customer may choose to pay in installments. To do so, the Customer must select the corresponding option during the ordering process. Payment is processed through the secure ALMA platform. If the Customer wishes to pay for the order in installments, they agree to ALMA's general and specific terms and conditions.
The commitment to pay made using a payment card is irrevocable. Orders placed on the Site imply a guarantee that the Customer has all the necessary authorizations to use the payment methods provided.
In certain cases, including non-payment, incorrect address or other problem with the Customer's account, Marmax reserves the right to suspend or cancel any Customer order until the problem is resolved.
Order confirmation implies acceptance of these Terms and Conditions, acknowledgement of having read and understood them fully, and waiver of any conflicting terms and conditions of purchase. All data provided and the recorded confirmation will serve as proof of the transaction. Marmax will send the Customer an email confirming the order registration to the address provided when creating their account.
The sale will be considered final after confirmation of acceptance of the order and receipt by the seller of the full price.

Article 6. Ownership and Transfer of Risks
Ownership and the associated risks of loss and damage will only transfer upon full payment of the price by the Customer, regardless of the delivery date. Marmax retains full ownership of the products sold until full payment of the price, including principal, fees, and taxes, has been received.
Article 7. Withdrawal
For any order placed from December 1st to December 24th, 2025 inclusive, returns are extended until January 5th, 2026.
In accordance with the provisions of Article L221-18 of the Consumer Code, the Customer has a period of fourteen full calendar days from the receipt of the order to exercise his right of withdrawal and return the Product to the company Marmax for reimbursement without penalty.
The right of withdrawal can be exercised by sending an email to contact@stellaetsuzie.com, or a letter by post using the form attached to these Terms and Conditions. Any other method of declaring withdrawal is also accepted. It must be unambiguous and clearly express the intention to withdraw.
Products must be returned in their original packaging, in perfect condition, new, unworn, unwashed, undamaged, unsoiled, and incomplete within 14 days of notifying Marmax of the Customer's decision to withdraw from the contract. Otherwise, they will not be accepted for return or exchange.
To prevent damage, all leather goods must be returned with the protective strips. Similarly, bags and hats must also be returned with the provided padding.
For hygiene reasons, on lingerie or swimwear, the protective tab located at the crotch must be present and will be changed before any restocking.
Marmax reserves the right to refuse the return of Products that do not comply with the conditions mentioned above.
Returns are made via a prepaid return label.
For all returns (excluding those from the United States and Canada), a flat fee will be charged to the customer and deducted from any refund. This flat fee will be €5 for returns from mainland France, the European Union, and Switzerland; £5 for returns from the United Kingdom; and $10 for the rest of the world.
In the event of a return of the entire order, the full amount paid by the Customer, less the "return fee," will be refunded by Marmax. The refund will be issued no later than 14 (fourteen) days following the date on which Marmax is notified of the Customer's decision to withdraw. Marmax may withhold the refund until the Products are received or until the Customer provides proof of shipment. Return shipping costs are borne by Marmax if the delivered Product differs from the ordered Product or is damaged. If the Customer fails to comply with these Terms and Conditions, particularly the return conditions, Marmax will not be able to refund the Products in question.
Marmax will issue the refund using the same payment method used for the original order. However, with the customer's express consent, another method may be used, unless the order was paid for with a gift card or store credit. The customer may then choose to receive a store credit, instead of a refund, for the full amount paid for the initial order. The store credit is valid for twelve months from its date of issue and can be used for any future purchase made on the website or in our stores (excluding department store concessions).
If you return an order purchased via a gift card and/or a credit note, your refund will be issued automatically and only in the form of a new credit note; other methods of refund, namely cash or payment card, are excluded in this case.
The customer may choose to receive a credit note corresponding to the full amount paid by the customer instead of a refund, valid for 12 months.
When Marmax detects abusive activity, including but not limited to orders delivered and then returned excessively or multiple returns not conforming to the conditions mentioned above which have resulted in refusals of returns, Marmax reserves the right to charge the Customer for the return costs in full, not to refund returns and/or to deactivate the account and any associated accounts.

Article 8. Delivery
Deliveries are made to the address indicated by the Customer on the order form, which must be within the agreed geographical area. Any package returned to Marmax due to an incorrect or incomplete delivery address will be reshipped at the Customer's expense.
Shipping is provided by Colissimo, Chronopost, DHL or Mondial Relay depending on the option chosen by the Customer when validating their order.
The delivery times indicated on the Website are estimates; they correspond to average processing and delivery times. Marmax cannot be held liable for any consequences resulting from a delivery delay that is not its fault.
However, if delivery times exceed thirty days from the order date, the sales contract may be cancelled and the Customer refunded.
Orders placed via Colissimo, delivery services with tracking, delivery without signature.
Marmax will provide the Customer with the tracking number for their package via email. The Customer's order will be delivered to their home by their postal carrier. If the Customer is not home, they will receive a delivery notice from their postal carrier, allowing them to collect the ordered products from the post office or the nearest collection point within the timeframe specified by the postal service. The Customer assumes all risks associated with shipping from the moment the items are physically received. The Customer is required to check the condition of the packaging and its contents upon delivery, in the presence of the postal worker or delivery person (or within 10 days of receipt to file a complaint with the delivery service).
Article 9. Guarantees
9.1. Legal guarantee of conformity and legal guarantee against hidden defects
Marmax guarantees the conformity of the goods to the contract, allowing the Customer to make a claim under the legal guarantee of conformity provided for in Articles L.217-4 et seq. of the Consumer Code or the guarantee against hidden defects in the thing sold within the meaning of Articles 1641 et seq. of the Civil Code.
In the event of implementation of the legal guarantee of conformity, it is reminded that:
-The customer has a period of 2 years from the delivery of the goods to take action;
-The Customer may choose repair or replacement of the goods depending on available stock, subject to the cost conditions provided for in Article L.217-17 of the Consumer Code;
- the Customer is exempt from providing proof of the existence of the non-conformity of the goods during the 24 months following delivery of the goods;
- The legal guarantee of conformity applies independently of any possible commercial guarantee.
The Customer may choose to invoke the warranty against hidden defects in the goods sold, as defined in Article 1641 of the Civil Code. In this case, they may choose between rescinding the sale or obtaining a price reduction, in accordance with Article 1644 of the Civil Code.
9.2. Implementation procedures for the guarantees
Customers requesting the benefit of the legal guarantee of conformity or against hidden defects must send their request to customer service via email at contact@stellaetsuzie.com. Customers may return the product using the return slip provided by customer service.
Prior to this return, the Customer must absolutely contact the after-sales service by telephone at 09 83 49 12 75 (Monday to Friday from 9am to 1pm and from 2pm to 6pm) or electronically at contact@stellaetsuzie.com.
9.3. Limitation of Liability
Marmax's liability with respect to any Product purchased on the Site is strictly limited to the purchase price of the latter.
Marmax shall not be held liable for any damage resulting from the use of the Internet network such as data loss, intrusions, viruses, service interruption, or other unintentional problems.
9.4. Force Majeure
In the event of an unforeseen circumstance or force majeure preventing the normal execution of the order or these Terms and Conditions, Marmax shall not be held liable. As defined by Article 1218 of the French Civil Code, force majeure is an external, unforeseeable, and irresistible event. It includes any act, event, non-occurrence, omission, or accident beyond the scope of Marmax's contract.
The performance of these General Terms and Conditions will be suspended for the duration of the force majeure event, and performance and delivery deadlines will be extended accordingly. Marmax will make every effort to end the force majeure event or find a solution enabling it to fulfill its contractual obligations.
Article 10. Intellectual Property
The company Marmax owns the domain name stellaetsuzie.com. The Site is an intellectual work protected by intellectual property laws. The Site as a whole and each of its constituent elements (such as source scripts, basic data, films, photographs, logos, trademarks, designs or models, texts, site structure, software, animations, illustrations, design, ergonomics, graphics, and the organization and titles of sections) are the exclusive property of the company Marmax.
Any use, reproduction, modification even partial of these elements is prohibited without the prior written authorization of the company Marmax.
Article 11. Personal Data
The Customer is informed and agrees that his personal data may be collected on the Site and used by the company Marmax which acts as data controller within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter "GDPR").
Marmax is committed to protecting and ensuring the security and confidentiality of its Clients' personal data in accordance with the GDPR, in particular by taking all necessary precautions to prevent this data from being distorted, damaged or accessed by unauthorized third parties.
In particular, the personal data of Customers may be transmitted to service providers and contractual partners who, as subcontractors within the meaning of the GDPR, intervene and contribute directly to the management of orders and for whom it is absolutely necessary to access the personal data entered by the Customer when creating and using their account (identity, postal address, telephone number, email).
Customer personal data is collected for the following purposes:
- Order management and customer relations,
- providing customers with information regarding offers and commercial information related to the brands,
- strengthening and improving website and brand communication through, in particular, the sending of newsletters and special offers based on customer preferences observed on the website,
- the improvement and personalization of services offered to Clients,
- compliance with legal and regulatory obligations.
Marmax is committed to protecting the confidentiality of information provided by the Client, which may be required for the use of certain services. All information concerning the Client is subject to the provisions of French Law No. 78-17 of 6 January 1978.

Article 12. Applicable Law - Dispute Resolution
These Terms and Conditions are governed by French law.
In the event of translation of the Site and the Terms and Conditions, the French language shall prevail for interpretation.
In the event of a dispute, the Customer should first contact Marmax to seek an amicable solution by contacting Customer Service.
If the dispute could not be resolved within the framework of the written complaint previously submitted to Customer Service, the Customer has the right to appeal free of charge to a consumer mediator with a view to the amicable resolution of the dispute which opposes him to the company Marmax.
The Client may only refer the matter to a mediator if they can prove that they have previously made a written complaint to the professional, and this within a limit of one year following this written complaint.
In the event of a dispute between the Client and Marmax, the Client may resort to the consumer mediator appointed by Marmax, in order to resolve the dispute amicably.
The consumer mediator for Marmax is CM2C. The Customer may contact this mediator via their website https://www.cm2c.net/ or by mail: 14 rue Saint Jean 75017 Paris.
All costs related to recourse to the consumer mediator will be borne by Marmax.
The Customer has the option to register free of charge on a telephone marketing opt-out list such as BLOCTEL (www.bloctel.gouv.fr) in order to no longer be contacted by telephone by a professional with whom you do not have a current contractual relationship, in accordance with Law No. 2014-344 of March 17, 2014 relating to consumer affairs.
Any consumer has the option to register for free on this list at https://conso.bloctel.fr/index.php/inscription.php.
In the context of extended producer responsibility for waste and in accordance with the provisions of articles L541-10 to L541-10-17 of the Environmental Code, Marmax informs the Client that it has joined several eco-organizations in order to fulfill its obligations.
To this end, the company Marmax has unique identification numbers (IDU) which certify that it is duly registered with the following eco-organizations and that it is up to date with its eco-contributions:
- IDU for the sector "textile products clothing, footwear, household linen intended for households and new textile products for the home" with the eco-organization REFASHION: FR360387_11WCZQ.
This IDU is valid for one (1) year and is renewed annually. The Client can consult Refashion's missions and objectives directly via the following internet link: https://refashion.fr/citoyen/fr.
